Public offer

This Public Offer (hereinafter referred to as the "Offer") governs the relationship between the owner of the online classifieds platform Prayk.com (hereinafter referred to as the "Administration", the "Website", the "Platform", or "Prayk.com") and any individual or legal entity (hereinafter referred to as the "User") using the Website to publish, browse, search, and manage advertisements.

By registering on the Website, posting an advertisement, or using any functionality of the Platform, the User fully and unconditionally accepts the terms of this Offer.

1. Terms and Definitions

Prayk.com (Platform) – an online platform for publishing advertisements for the sale, purchase, exchange, rental of goods, provision of services, and other offers permitted by law.

User – an individual, sole proprietor, or legal entity using the Platform.

Advertisement – information posted by a User on the Platform for the purpose of offering or seeking goods, services, work, rentals, or other lawful transactions.

Account – a User account created on Prayk.com.

2. Subject of the Offer

2.1. Prayk.com provides Users with the technical ability to:

  • browse advertisements posted by other Users;

  • exchange messages with other Users;

  • use additional paid services of the Platform;

  • publish reviews and ratings where such functionality is available.

2.2. Prayk.com is solely an informational online platform and is not:

  • a seller;

  • a buyer;

  • an intermediary;

  • an agent;

  • a commission merchant;

  • a party to any transaction between Users.

2.3. All transactions between Users are concluded independently and at their own risk.

3. Registration and Account

3.1. Registration is required to access certain features of the Platform.

3.2. The User agrees to provide accurate and up-to-date information.

3.3. The User is solely responsible for maintaining the confidentiality of their login credentials.

3.4. All actions performed through the User's Account shall be deemed to have been performed by the User.

3.5. The Administration reserves the right to temporarily restrict or block an Account in the event of a violation of this Offer.

4. Posting Advertisements

The User represents and warrants that they:

  • have the right to post the relevant advertisement;

  • provide truthful and accurate information;

  • do not infringe the rights of third parties;

  • comply with the laws of the Republic of Azerbaijan and other applicable laws.

The following advertisements are prohibited:

  • narcotic drugs and controlled substances;

  • weapons and ammunition;

  • explosives;

  • counterfeit products;

  • forged documents;

  • pyramid schemes;

  • fraudulent services;

  • materials infringing intellectual property rights;

  • goods and services prohibited by law;

  • any goods or services that violate public order or morality.

The Administration of Prayk.com may, without prior notice:

  • reject the publication of advertisements;

  • change advertisement categories;

  • hide advertisements;

  • remove advertisements;

  • limit the publication of advertisements;

  • block Users who violate these Terms.

5. Paid Services

Prayk.com may offer the following paid services:

  • VIP placement;

  • advertisement promotion (bumping);

  • highlighted advertisements;

  • featured listings;

  • advertising promotion services;

  • banner advertising;

  • other additional services.

The prices of paid services are published on Prayk.com.

Payment for any service does not guarantee the sale of goods, acquisition of customers, or achievement of any particular result.

6. User Responsibility

The User is solely responsible for:

  • the content of advertisements;

  • the accuracy of the information provided;

  • the quality of goods and services;

  • fulfilling obligations toward other Users;

  • compliance with applicable laws;

  • payment of taxes and other mandatory charges.

7. Limitation of Liability of Prayk.com

The Administration of Prayk.com shall not be liable for:

  • the content of advertisements;

  • actions of Users;

  • the quality of goods and services;

  • the conclusion or performance of transactions;

  • losses resulting from the use of the Platform;

  • fraudulent actions of third parties;

  • technical failures;

  • temporary unavailability of the Website;

  • loss of information due to circumstances beyond the Administration's control.

Prayk.com does not verify every advertisement for accuracy and does not guarantee the authenticity of information posted by Users.

8. Intellectual Property

All rights to the software, design, logo, database, texts, and other elements of Prayk.com belong to the Administration or are used on lawful grounds.

By posting materials on the Platform, the User grants Prayk.com a non-exclusive, royalty-free, worldwide license to use photographs, descriptions, and other materials solely for the operation, promotion, and advertising of the Platform.

9. Personal Data

By using Prayk.com, the User consents to the processing of personal data in accordance with the Platform's Privacy Policy.

10. Account Suspension and Termination

The Administration may restrict or terminate a User's access to the Platform in the event of:

  • violation of this Offer;

  • posting prohibited content;

  • fraudulent activities;

  • spamming;

  • attempts to disrupt the operation of the Website;

  • multiple complaints from other Users;

  • provision of false or misleading information.

11. Dispute Resolution

Any disputes and disagreements shall first be resolved through negotiations.

If a dispute cannot be resolved amicably, it shall be governed by and interpreted in accordance with the laws of the Republic of Azerbaijan, and shall be subject to the jurisdiction of the courts at the place of registration of the owner of Prayk.com.

12. Amendments to the Offer

The Administration of Prayk.com reserves the right to amend this Offer at any time by publishing a revised version on the Website.

Continued use of the Platform after such amendments constitutes the User's full acceptance of the revised Offer.
