Buying an apartment without a title deed: risks and checks

Buying an apartment without a title deed (an extract from the state register, locally called "kupça") means buying a property whose seller's ownership is not confirmed in the state register, so the buyer takes on the main risk. According to Prayk's measurement on 27 September 2026, 74% of apartment sale listings in Baku state a title deed, while 13% of new-build listings explicitly say "no deed". Interestingly, new builds without a deed are offered only 3% cheaper per m² than those with one, so there is almost no discount for the risk. Below are the risks, the checks based on official sources, and the numbers.

Short answer: as of 27 September 2026, Prayk has 41,915 apartment sale listings in Baku, and 31,138 of them (74%) state a title deed. Explicitly without a deed: 13% of new-build listings and 1% of older-building listings. New builds without a deed have a median of 2,780 AZN/m², against 2,857 AZN/m² with a deed, a 3% gap. If you buy without a deed, at the very least check the building's legal status (the developer's ownership of the building, or acceptance of a cooperative's building into operation), sign the contract at a notary and do not pay a large deposit. This is general information, not legal advice.

What is a title deed and why does it matter?

According to the State Service for Property Issues, under Article 2.1 of the Law on the State Register of Real Estate, state registration of rights to real estate is the recognition and confirmation by the state that rights have arisen, been restricted (encumbered), transferred or terminated. The document confirming registration is the extract from the state real estate register, issued electronically. Put simply, the extract is the state's confirmation that "this apartment belongs to this person". Without it there is no such confirmation, and ownership has to be proved with other documents: a contract, a cooperative's decision, receipts.

How many listings on Prayk have no deed, and is there a price gap?

The figures below are based on the "title deed" field the seller fills in. The Baku total comes from the API on 27 September 2026, and the breakdown is calculated from the most recent listings in each group.

SegmentListings measuredDeed stated"No deed"Not stated

Baku — new builds29973%13%14%

2 rooms2,877 (75)3,000 (21)no deed 4% more expensive
3 rooms2,907 (107)— (13 listings)—

The result is unexpected: in Baku, new builds without a deed are not sold at a noticeable discount. The reason is that many of them are in buildings under construction or recently completed, often in central locations, and sellers price in the deed "coming later". For a buyer this means you are not automatically compensated for the risk in the price. In older buildings and in the Absheron sample there are few listings without a deed (4 and 14), so we do not give a median there.

What are the main risks of buying without a deed?

  • Ownership is not confirmed. You cannot check against the state register that the seller really is the owner; other people may also have claims on the same apartment.
  • The deed may never arrive. If the developer's (LLC's) ownership of the building is not registered, or a cooperative's building has not been accepted into operation, getting a deed for the apartment can drag on or stall.
  • Encumbrances are invisible. Mortgages, seizures and other restrictions on registered property are checked with a certificate from the register; for an apartment without a deed that route is closed.
  • Financing. If you want a mortgage, ask the bank in advance whether it will accept an apartment without a deed as collateral.
  • Resale and inheritance. Selling, gifting or passing on the apartment in future also requires documents, and the pool of buyers for an apartment without a deed is smaller.
  • Disputes. Disputes over registered rights are settled in court; proving ownership without a deed in court is harder.

What should you check before buying?

  1. If there is a deed, verify it. According to the State Service for Property Issues, an electronic extract can be checked on the e-services.economy.gov.az portal using the "Elektron çıxarışın yoxlanması" (electronic extract verification) service with the register and registration numbers. Compare the name on the extract with the seller's ID.
  2. Ask for an encumbrance certificate. A register certificate on the property's description, registered rights and encumbrances is issued to the right holder, their authorised representative and heirs within 1 working day. Ask the seller to obtain it.
  3. New build by an LLC. Find out whether the company's ownership of the building is recorded in the state register. If it is, a notarised sale contract is signed between the company and the buyer, and on that basis the buyer can obtain a deed in their own name.
  4. New build by a housing cooperative (MTK). Check that there is a certificate accepting the building into operation. The deed requires a decision of the MTK members' general meeting on allocating the apartment and a financial certificate showing the share contribution has been paid with no debt.
  5. If the sale is by power of attorney, check the notarised power of attorney and its authority to sell.
  6. Pay in stages and against documents. Do not pay a large deposit without a viewing and a contract; confirm every payment in writing.
  7. Registration after purchase. Rights are registered within 10 working days of the application (extendable by up to 5 working days if boundary and inventory work is needed).

How do you filter for apartments with a deed on Prayk?

  • In the Real estate search, the "With title deed" option shows only listings that state a deed. Remember this is the seller's declaration, so still check the document.
  • In the "What's my home worth?" tool you can set the "Title deed" field and compare the apartment's market value with and without a deed.
  • Check a specific listing with the "Check a listing" report on the listing page: price history and market comparison quickly expose a suspiciously cheap "bait" listing.
  • If you are choosing between a new build and an older building: new build or older building. If you are buying land: buying a land plot — documents and traps.

Frequently asked questions

Can you buy an apartment without a title deed?

You can, but since ownership is not confirmed in the state register, the risk falls on the buyer. For a new build, first check the building's legal status (the developer's ownership of the building, or a cooperative building's acceptance into operation). This is general information; consult a lawyer or the State Service for Property Issues before the deal.

How much cheaper is an apartment without a deed?

According to Prayk's measurement on 27 September 2026, new builds without a deed in Baku have a median of 2,780 AZN/m², against 2,857 AZN/m² with a deed, a gap of just 3%. For two-room apartments, those without a deed are even 4% more expensive. So the market offers no meaningful discount for the risk.

How do you verify an electronic extract?

According to the State Service for Property Issues, on the e-services.economy.gov.az portal you select the "Elektron çıxarışın yoxlanması" service, enter the registration and register numbers and press "Axtar" (Search).

How do you get a deed for an apartment bought from a cooperative?

First it is established whether the building has been accepted into operation. If so, two documents are required: a decision of the MTK members' general meeting on allocating the apartment and a financial certificate showing the share contribution has been paid.

How long does it take to get a deed?

Rights are registered within 10 working days of the application; if boundary and inventory work is needed, the period can be extended by up to 5 working days.

Sources and methodology

Listing data come from Prayk's open catalogue API on 27 September 2026: "Real estate → Apartments" section, operation "sale". The Baku total (41,915) and the number of listings stating a deed (31,138) are API totals. The breakdown and prices are calculated from the 300 most recent sale listings each for new and older buildings in Baku (excluding erroneous prices below 10,000 AZN) and from the 200 most recent sale listings in Absheron district (183 of them new builds). The "title deed" field is the seller's declaration, not a document check. Price per m² is price ÷ area for listings of 15–500 m²; we do not publish a median for segments with fewer than 15 listings.
